Die Vertraulichkeit und Integrität Ihrer personenbezogenen Daten ist uns ein besonderes Anliegen.

Die Bayerische Motoren Werke Aktiengesellschaft, Petuelring 130, 80788 München, Sitz und Registergericht: München HRB 42243 (nachfolgend „BMW“) ist Anbieter der ONE WORKSPACE Mobile / ONE@BMWGROUP App (nachfolgend „App) und Verantwortliche für die Datenverarbeitung im Sinne der Datenschutz-Grundverordnung und anderer nationaler Datenschutzgesetze der Mitgliedsstaaten sowie sonstiger datenschutzrechtlicher Bestimmungen.

Im Folgenden möchten wir Sie über die im Rahmen der ONE WORKSPACE Mobile / ONE@BMWGROUP App erfolgende Datenverarbeitung informieren:

I. Allgemeine Funktionen der App

Wir verarbeiten personenbezogene Daten unserer Nutzer grundsätzlich nur, soweit dies zur Bereitstellung einer funktionsfähigen App oder Website sowie unserer Inhalte und Leistungen erforderlich ist.

1. Registrierung

Zur Erbringung weiterführender Dienste der App erfolgt bei Eingabe des Nutzernamens und der PIN, zwecks der Authentifizierung und Autorisierung, eine Übertragung der Daten an BMW. Sollte kein gültiger Account vorliegen, werden die eingegebenen Daten sofort gelöscht. Wir verarbeiten diese Daten zur Erfüllung des Vertrages über die Nutzung der App. Rechtsgrundlage hierfür ist (Art 6 Abs. 1 lit. b) DSGVO.

2. Verwendung von Cookies

Für den Betrieb der App bzw. der App-Webseite werden Cookies gesetzt, um einen geschützten Zugriff auf die Medien (z.B. Bilder und Videos) innerhalb der App zu ermöglichen. Wir verarbeiten diese Daten zur Erfüllung des Vertrages über die Nutzung der App. Rechtsgrundlage hierfür ist Art 6 Abs. 1 lit. b) DSGVO. Eingebettete Seiten wie bspw. die bmwgroup.com oder deren Unterseiten können eigenständige Cookies verwenden (siehe BMW GROUP COOKIE RICHTLINIEN). Die entsprechenden Regelungen finden sich dann auf den eingebetteten Seiten.

3. Zugriff und Erstellung von Logfiles

Bei Registrierung wird eine zufällige Registrierungs-ID generiert. Zudem wird für den Betrieb der App bzw. der App-Website eine zufällige Session ID generiert, die für die Dauer Ihrer Session erhalten bleibt. Diese Daten sind erforderlich, um bei Fehlfunktionen der App die Fehlersuche bei Supportanfragen durchführen zu können. Diese Verarbeitung dient dem berechtigten Interesse von BMW, den hohen Anforderungen an die Produkte und Services zu entsprechen und in der Lage zu sein, Supportanfragen schnell bearbeiten zu können. Rechtsgrundlage hierfür ist Art. 6 Abs.1 lit. f) DSGVO

II. Automatisierte Entscheidungsfindung

Es findet keine automatisierte Entscheidungsfindung gem. Art. 22 DSGVO statt.

III. Datensicherheit

Wir treffen technische und organisatorische Sicherheitsvorkehrungen, um Ihre personenbezogenen Daten gegen zufällige oder vorsätzliche Manipulationen, Verlust, Zerstörung oder gegen den Zugriff unberechtigter Personen zu schützen. Unsere Datenverarbeitung und unsere Sicherheitsmaßnahmen werden entsprechend der technologischen Entwicklung fortlaufend verbessert.

IV. Betroffenenrechte

Werden personenbezogene Daten von Ihnen verarbeitet, sind Sie Betroffener i.S.d. DSGVO und es stehen Ihnen folgende Rechte gegenüber dem Verantwortlichen zu:

1. Auskunftsrecht

Sie können von dem Verantwortlichen eine Bestätigung darüber verlangen, ob personenbezogene Daten, die Sie betreffen, von uns verarbeitet werden. Liegt eine solche Verarbeitung vor, können Sie von dem Verantwortlichen über folgende Informationen Auskunft verlangen: (1) die Zwecke, zu denen die personenbezogenen Daten verarbeitet werden; (2) die Kategorien von personenbezogenen Daten, welche verarbeitet werden; (3) die Empfänger bzw. die Kategorien von Empfängern, gegenüber denen die Sie betreffenden personenbezogenen Daten offengelegt wurden oder noch offengelegt werden; (4) die geplante Dauer der Speicherung der Sie betreffenden personenbezogenen Daten oder, falls konkrete Angaben hierzu nicht möglich sind, Kriterien für die Festlegung der Speicherdauer; (5) das Bestehen eines Rechts auf Berichtigung oder Löschung der Sie betreffenden personenbezogenen Daten, eines Rechts auf Einschränkung der Verarbeitung durch den Verantwortlichen oder eines Widerspruchsrechts gegen diese Verarbeitung; (6) das Bestehen eines Beschwerderechts bei einer Aufsichtsbehörde; (7) alle verfügbaren Informationen über die Herkunft der Daten, wenn die personenbezogenen Daten nicht bei der betroffenen Person erhoben werden; (8) das Bestehen einer automatisierten Entscheidungsfindung einschließlich Profiling gemäß Art. 22 Abs. 1 und 4 DSGVO und – zumindest in diesen Fällen – aussagekräftige Informationen über die involvierte Logik sowie die Tragweite und die angestrebten Auswirkungen einer derartigen Verarbeitung für die betroffene Person. Ihnen steht das Recht zu, Auskunft darüber zu verlangen, ob die Sie betreffenden personenbezogenen Daten in ein Drittland oder an eine internationale Organisation übermittelt werden. In diesem Zusammenhang können Sie verlangen, über die geeigneten Garantien gem. Art. 46 DSGVO im Zusammenhang mit der Übermittlung unterrichtet zu werden.

2. Recht auf Berichtigung

Sie haben ein Recht auf Berichtigung und/oder Vervollständigung gegenüber dem Verantwortlichen, sofern die verarbeiteten personenbezogenen Daten, die Sie betreffen, unrichtig oder unvollständig sind. Der Verantwortliche hat die Berichtigung unverzüglich vorzunehmen.

3. Recht auf Einschränkung der Verarbeitung

Unter den folgenden Voraussetzungen können Sie die Einschränkung der Verarbeitung der Sie betreffenden personenbezogenen Daten verlangen: (1) wenn Sie die Richtigkeit der Sie betreffenden personenbezogenen für eine Dauer bestreiten, die es dem Verantwortlichen ermöglicht, die Richtigkeit der personenbezogenen Daten zu überprüfen; (2) die Verarbeitung unrechtmäßig ist und Sie die Löschung der personenbezogenen Daten ablehnen und stattdessen die Einschränkung der Nutzung der personenbezogenen Daten verlangen; (3) der Verantwortliche die personenbezogenen Daten für die Zwecke der Verarbeitung nicht länger benötigt, Sie diese jedoch zur Geltendmachung, Ausübung oder Verteidigung von Rechtsansprüchen benötigen, oder (4) wenn Sie Widerspruch gegen die Verarbeitung gemäß Art. 21 Abs. 1 DSGVO eingelegt haben und noch nicht feststeht, ob die berechtigten Gründe des Verantwortlichen gegenüber Ihren Gründen überwiegen. Wurde die Verarbeitung der Sie betreffenden personenbezogenen Daten eingeschränkt, dürfen diese Daten – von ihrer Speicherung abgesehen – nur mit Ihrer Einwilligung oder zur Geltendmachung, Ausübung oder Verteidigung von Rechtsansprüchen oder zum Schutz der Rechte einer anderen natürlichen oder juristischen Person oder aus Gründen eines wichtigen öffentlichen Interesses der Union oder eines Mitgliedstaats verarbeitet werden. Wurde die Einschränkung der Verarbeitung nach den o.g. Voraussetzungen eingeschränkt, werden Sie von dem Verantwortlichen unterrichtet bevor die Einschränkung aufgehoben wird.

4. Recht auf Löschung

a. Löschungspflicht

Sie können von dem Verantwortlichen verlangen, dass die Sie betreffenden personenbezogenen Daten unverzüglich gelöscht werden, und der Verantwortliche ist verpflichtet, diese Daten unverzüglich zu löschen, sofern einer der folgenden Gründe zutrifft: (1) Die Sie betreffenden personenbezogenen Daten sind für die Zwecke, für die sie erhoben oder auf sonstige Weise verarbeitet wurden, nicht mehr notwendig. (2) Sie widerrufen Ihre Einwilligung, auf die sich die Verarbeitung gem. Art. 6 Abs. 1 lit. a oder Art. 9 Abs. 2 lit. a DSGVO stützte, und es fehlt an einer anderweitigen Rechtsgrundlage für die Verarbeitung. (3) Sie legen gem. Art. 21 Abs. 1 DSGVO Widerspruch gegen die Verarbeitung ein und es liegen keine vorrangigen berechtigten Gründe für die Verarbeitung vor, oder Sie legen gem. Art. 21 Abs. 2 DSGVO Widerspruch gegen die Verarbeitung ein. (4) Die Sie betreffenden personenbezogenen Daten wurden unrechtmäßig verarbeitet. (5) Die Löschung der Sie betreffenden personenbezogenen Daten ist zur Erfüllung einer rechtlichen Verpflichtung nach dem Unionsrecht oder dem Recht der Mitgliedstaaten erforderlich, dem der Verantwortliche unterliegt. (6) Die Sie betreffenden personenbezogenen Daten wurden in Bezug auf angebotene Dienste der Informationsgesellschaft gemäß Art. 8 Abs. 1 DSGVO erhoben.

b. Information an Dritte

Hat der Verantwortliche die Sie betreffenden personenbezogenen Daten öffentlich gemacht und ist er gem. Art. 17 Abs. 1 DSGVO zu deren Löschung verpflichtet, so trifft er unter Berücksichtigung der verfügbaren Technologie und der Implementierungskosten angemessene Maßnahmen, auch technischer Art, um für die Datenverarbeitung Verantwortliche, die die personenbezogenen Daten verarbeiten, darüber zu informieren, dass Sie als betroffene Person von ihnen die Löschung aller Links zu diesen personenbezogenen Daten oder von Kopien oder Replikationen dieser personenbezogenen Daten verlangt haben.

c. Ausnahmen

Das Recht auf Löschung besteht nicht, soweit die Verarbeitung erforderlich ist (1) zur Ausübung des Rechts auf freie Meinungsäußerung und Information; (2) zur Erfüllung einer rechtlichen Verpflichtung, die die Verarbeitung nach dem Recht der Union oder der Mitgliedstaaten, dem der Verantwortliche unterliegt, erfordert, oder zur Wahrnehmung einer Aufgabe, die im öffentlichen Interesse liegt oder in Ausübung öffentlicher Gewalt erfolgt, die dem Verantwortlichen übertragen wurde; (3) aus Gründen des öffentlichen Interesses im Bereich der öffentlichen Gesundheit gemäß Art. 9 Abs. 2 lit. h und i sowie Art. 9 Abs. 3 DSGVO; (4) für im öffentlichen Interesse liegende Archivzwecke, wissenschaftliche oder historische Forschungszwecke oder für statistische Zwecke gem. Art. 89 Abs. 1 DSGVO, soweit das unter Abschnitt a) genannte Recht voraussichtlich die Verwirklichung der Ziele dieser Verarbeitung unmöglich macht oder ernsthaft beeinträchtigt, oder (5) zur Geltendmachung, Ausübung oder Verteidigung von Rechtsansprüchen.

5. Recht auf Unterrichtung

Haben Sie das Recht auf Berichtigung, Löschung oder Einschränkung der Verarbeitung gegenüber dem Verantwortlichen geltend gemacht, ist dieser verpflichtet, allen Empfängern, denen die Sie betreffenden personenbezogenen Daten offengelegt wurden, diese Berichtigung oder Löschung der Daten oder Einschränkung der Verarbeitung mitzuteilen, es sei denn, dies erweist sich als unmöglich oder ist mit einem unverhältnismäßigen Aufwand verbunden. Ihnen steht gegenüber dem Verantwortlichen das Recht zu, über diese Empfänger unterrichtet zu werden.

6. Recht auf Datenübertragbarkeit

Sie haben das Recht, die Sie betreffenden personenbezogenen Daten, die Sie dem Verantwortlichen bereitgestellt haben, in einem strukturierten, gängigen und maschinenlesbaren Format zu erhalten. Außerdem haben Sie das Recht diese Daten einem anderen Verantwortlichen ohne Behinderung durch den Verantwortlichen, dem die personenbezogenen Daten bereitgestellt wurden, zu übermitteln, sofern (1) die Verarbeitung auf einer Einwilligung gem. Art. 6 Abs. 1 lit. a DSGVO oder Art. 9 Abs. 2 lit. a DSGVO oder auf einem Vertrag gem. Art. 6 Abs. 1 lit. b DSGVO beruht und (2) die Verarbeitung mithilfe automatisierter Verfahren erfolgt. In Ausübung dieses Rechts haben Sie ferner das Recht, zu erwirken, dass die Sie betreffenden personenbezogenen Daten direkt von einem Verantwortlichen einem anderen Verantwortlichen übermittelt werden, soweit dies technisch machbar ist. Freiheiten und Rechte anderer Personen dürfen hierdurch nicht beeinträchtigt werden. Das Recht auf Datenübertragbarkeit gilt nicht für eine Verarbeitung personenbezogener Daten, die für die Wahrnehmung einer Aufgabe erforderlich ist, die im öffentlichen Interesse liegt oder in Ausübung öffentlicher Gewalt erfolgt, die dem Verantwortlichen übertragen wurde.

7. Widerspruchsrecht

Sie haben das Recht, aus Gründen, die sich aus ihrer besonderen Situation ergeben, jederzeit gegen die Verarbeitung der Sie betreffenden personenbezogenen Daten, die aufgrund von Art. 6 Abs. 1 lit. e oder f DSGVO erfolgt, Widerspruch einzulegen. Der Verantwortliche verarbeitet die Sie betreffenden personenbezogenen Daten nicht mehr, es sei denn, er kann zwingende schutzwürdige Gründe für die Verarbeitung nachweisen, die Ihre Interessen, Rechte und Freiheiten überwiegen, oder die Verarbeitung dient der Geltendmachung, Ausübung oder Verteidigung von Rechtsansprüchen. Sie haben die Möglichkeit, im Zusammenhang mit der Nutzung von Diensten der Informationsgesellschaft – ungeachtet der Richtlinie 2002/58/EG – Ihr Widerspruchsrecht mittels automatisierter Verfahren auszuüben, bei denen technische Spezifikationen verwendet werden.

8. Recht auf Widerruf der datenschutzrechtlichen Einwilligungserklärung

Sie haben das Recht, Ihre datenschutzrechtliche Einwilligungserklärung jederzeit zu widerrufen. Durch die Ausübung des Widerrufsrechts bleibt die Rechtmäßigkeit der entsprechend der Einwilligung bis zum Widerruf erfolgten Verarbeitung unberührt.

9. Recht auf Beschwerde bei einer Aufsichtsbehörde

Unbeschadet eines anderweitigen verwaltungsrechtlichen oder gerichtlichen Rechtsbehelfs steht Ihnen das Recht auf Beschwerde bei einer Aufsichtsbehörde, insbesondere in dem Mitgliedstaat ihres Aufenthaltsorts, ihres Arbeitsplatzes oder des Orts des mutmaßlichen Verstoßes, zu, wenn Sie der Ansicht sind, dass die Verarbeitung der Sie betreffenden personenbezogenen Daten gegen die DSGVO verstößt. Die Aufsichtsbehörde, bei der die Beschwerde eingereicht wurde, unterrichtet den Beschwerdeführer über den Stand und die Ergebnisse der Beschwerde einschließlich der Möglichkeit eines gerichtlichen Rechtsbehelfs nach Art. 78 DSGVO.

Bayerische Motoren Werke Aktiengesellschaft, Petuelring 130, 80788 Munich, registered office and registry court: Munich HRB 42243 (hereinafter "BMW") is the provider of the ONE WORKSPACE Mobile / ONE@BMWGROUP app (hereinafter "app") and is responsible for data processing within the meaning of the General Data Protection Regulation and other national data protection laws of the member states as well as other data protection regulations.

In the following, we would like to inform you about the data processing that takes place within the framework of the ONE WORKSPACE Mobile / ONE@BMWGROUP app:

I. General functions of the App

We only process the personal data of our users to the extent necessary to provide a functional app or website and our content and services.

1. Registration

In order to provide further services of the app, the data is transferred to BMW when the user name and PIN are entered for authentication and authorization purposes. If no valid account exists, the data entered is deleted immediately. We process this data to fulfill the contract for the use of the app. The legal basis for this is (Art. 6 (1) (b) GDPR).

2. Use of cookies

Cookies are set for the operation of the app and the app website to enable protected access to media (e.g., images and videos) within the app. We process this data to fulfill the contract for the use of the app. The legal basis for this is Art. 6 (1) lit. b) GDPR. Embedded pages such as bmwgroup.com or its subpages may use independent cookies (see BMW GROUP COOKIE POLICY). The relevant regulations can then be found on the embedded pages.

3. Access and creation of log files

A random registration ID is generated upon registration. In addition, a random session ID is generated for the operation of the app or the app website, which remains valid for the duration of your session. This data is necessary to enable troubleshooting in the event of app malfunctions when support requests are made. This processing serves BMW's legitimate interest in meeting the high requirements for its products and services and being able to process support requests quickly. The legal basis for this is Art. 6 (1) (f) GDPR.

II. Automated decision-making

No automated decision-making takes place in accordance with Art. 22 GDPR.

III. Data security

We take technical and organizational security measures to protect your personal data against accidental or intentional manipulation, loss, destruction, or access by unauthorized persons. Our data processing and security measures are continuously improved in line with technological developments.

IV. Rights of data subjects

If your personal data is processed, you are a data subject within the meaning of the GDPR and you have the following rights vis-à-vis the controller:

1. Right to information

You can request confirmation from the controller as to whether personal data concerning you is being processed by us. If such processing is taking place, you can request the following information from the controller: (1) the purposes for which the personal data is processed; (2) the categories of personal data that are being processed; (3) the recipients or categories of recipients to whom the personal data concerning you have been or will be disclosed; (4) the planned duration of storage of the personal data concerning you or, if specific information on this is not possible, criteria for determining the storage period; (5) the existence of a right to rectification or erasure of personal data concerning you, a right to restriction of processing by the controller, or a right to object to such processing; (6) the existence of a right to lodge a complaint with a supervisory authority; (7) any available information on the origin of the data if the personal data is not collected from the data subject; (8) the existence of automated decision-making, including profiling, pursuant to Art. 22 (1) and (4) GDPR and, at least in these cases, meaningful information about the logic involved, as well as the significance and the envisaged consequences of such processing for the data subject. You have the right to request information about whether personal data concerning you is being transferred to a third country or to an international organization. In this context, you may request to be informed about the appropriate safeguards pursuant to Art. 46 GDPR in connection with the transfer.

2. Right to rectification

You have the right to rectification and/or completion vis-à-vis the controller if the personal data processed concerning you is inaccurate or incomplete. The controller must rectify the data without delay.

3. Right to restriction of processing

Under the following conditions, you may request the restriction of the processing of personal data concerning you: (1) if you dispute the accuracy of the personal data concerning you for a period enabling the controller to verify the accuracy of the personal data; (2) the processing is unlawful and you oppose the erasure of the personal data and request the restriction of their use instead; (3) the controller no longer needs the personal data for the purposes of the processing, but you need it for the establishment, exercise, or defense of legal claims; or (4) if you have objected to the processing pursuant to Art. 21 (1) GDPR and it is not yet clear whether the legitimate grounds of the controller override your grounds. If the processing of personal data concerning you has been restricted, such data may, with the exception of storage, only be processed with your consent or for the establishment, exercise, or defense of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest of the Union or of a Member State. If the restriction of processing has been restricted in accordance with the above conditions, you will be informed by the controller before the restriction is lifted.

4. Right to erasure

a. Obligation to erase

You may request the controller to erase personal data concerning you without undue delay, and the controller is obliged to erase such data without undue delay if one of the following reasons applies: (1) The personal data concerning you is no longer necessary for the purposes for which it was collected or otherwise processed. (2) You withdraw your consent on which the processing was based in accordance with Art. 6 (1) (a) or Art. 9 (2) (a) GDPR, and there is no other legal basis for the processing. (3) You object to the processing pursuant to Art. 21 (1) GDPR and there are no overriding legitimate grounds for the processing, or you object to the processing pursuant to Art. 21 (2) GDPR. (4) The personal data concerning you has been processed unlawfully. (5) The erasure of personal data concerning you is necessary to comply with a legal obligation under Union law or the law of the Member States to which the controller is subject. (6) The personal data concerning you has been collected in relation to the services offered by information society services pursuant to Art. 8 (1) GDPR.

b. Information to third parties

If the controller has made the personal data concerning you public and is obliged to erase it pursuant to Art. 17 (1) GDPR, it shall take reasonable measures, including technical measures, taking into account the available technology and implementation costs, to inform controllers who process the personal data that you, as the data subject, have requested them to delete all links to this personal data or copies or replications of this personal data.

c. Exceptions

The right to erasure does not apply if processing is necessary (1) for exercising the right of freedom of expression and information; (2) for compliance with a legal obligation which requires processing by Union or Member State law to which the controller is subject or for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller; (3) for reasons of public interest in the area of public health pursuant to Art. 9 (2) (h) and (i) and Art. 9 (3) GDPR; (4) for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes pursuant to Art. 89(1) GDPR, insofar as the right referred to in section a) is likely to render impossible or seriously impair the achievement of the objectives of that processing; or (5) for the establishment, exercise, or defense of legal claims.

5. Right to be informed

If you have asserted your right to rectification, erasure, or restriction of processing against the controller, the controller is obliged to notify all recipients to whom your personal data has been disclosed of this rectification, erasure, or restriction of processing, unless this proves impossible or involves disproportionate effort. You have the right to be informed by the controller about these recipients.

6. Right to data portability

You have the right to receive the personal data concerning you that you have provided to the controller in a structured, commonly used, and machine-readable format. You also have the right to transmit this data to another controller without hindrance from the controller to whom the personal data has been provided, provided that (1) the processing is based on consent pursuant to Art. 6 (1) (a) GDPR or Art. 9 (2) (a) GDPR or on a contract pursuant to Art. 6 (1) (b) GDPR, and (2) the processing is carried out using automated means. In exercising this right, you also have the right to have the personal data concerning you transmitted directly from one controller to another controller, where technically feasible. The freedoms and rights of other persons must not be affected by this. The right to data portability does not apply to the processing of personal data necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.

7. Right to object

You have the right to object at any time, on grounds relating to your particular situation, to the processing of personal data concerning you which is carried out on the basis of Article 6(1)(e) or (f) GDPR. The controller will no longer process the personal data concerning you unless the controller can demonstrate compelling legitimate grounds for the processing which override your interests, rights, and freedoms, or the processing serves to assert, exercise, or defend legal claims. In connection with the use of information society services, you have the option of exercising your right to object by means of automated procedures using technical specifications, irrespective of Directive 2002/58/EC.

8. Right to revoke the data protection consent declaration

You have the right to revoke your declaration of consent under data protection law at any time. Exercising your right of revocation does not affect the lawfulness of the processing carried out in accordance with the consent until revocation.

9. Right to lodge a complaint with a supervisory authority

Without prejudice to any other administrative or judicial remedy, you have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, place of work or place of the alleged infringement, if you consider that the processing of personal data relating to you infringes the GDPR. The supervisory authority with which the complaint has been lodged shall inform the complainant of the status and outcome of the complaint, including the possibility of a judicial remedy under Article 78 GDPR.

1. Registro

Las páginas incrustadas, como por ejemplo bmwgroup.com o sus subpáginas, pueden utilizar cookies propias (véanse las DIRECTRICES DE COOKIES DEL BMW GROUP). 3. Acceso y creación de archivos de registro (logfiles)

Durante el registro se genera un ID de registro aleatorio. Además, para el funcionamiento de la App o del sitio web de la App se genera un ID de sesión aleatorio que se conserva durante toda la sesión. Estos datos son necesarios para poder realizar la búsqueda de errores en caso de malfuncionamientos de la App durante solicitudes de soporte. Este tratamiento responde al interés legítimo de BMW de cumplir con las altas exigencias de productos y servicios y de poder gestionar rápidamente las solicitudes de soporte. La base jurídica es el art. 6, apdo. 1, letra f) del RGPD.

II. Toma de decisiones automatizada

No se lleva a cabo ninguna toma de decisiones automatizada conforme al art. 22 del RGPD.

III. Seguridad de los datos

Adoptamos medidas técnicas y organizativas de seguridad para proteger sus datos personales contra manipulaciones accidentales o intencionadas, pérdida, destrucción o acceso por personas no autorizadas. Nuestro tratamiento de datos y nuestras medidas de seguridad se mejoran continuamente de acuerdo con la evolución tecnológica.

IV. Derechos del interesado

Si se procesan datos personales que le conciernen, usted es un interesado en el sentido del RGPD y tiene los siguientes derechos frente al responsable:

1. Derecho de acceso

Puede solicitar confirmación sobre si tratamos sus datos personales. También tiene derecho a ser informado sobre transferencias a terceros países o a organizaciones internacionales y sobre las garantías adecuadas conforme al art. 46 del RGPD.

2. Derecho de rectificación

Tiene derecho a solicitar la rectificación o la completación de sus datos personales si son incorrectos o incompletos. El responsable deberá hacerlo sin dilación indebida.

3. Derecho a la limitación del tratamiento

Puede solicitar la limitación del tratamiento si: (1) impugna la exactitud de los datos, durante el tiempo que permita verificarla; (2) el tratamiento es ilícito y solicita la limitación en lugar de la supresión; (3) los datos ya no son necesarios para el responsable, pero usted los necesita para ejercer o defender reclamaciones legales; (4) ha presentado oposición y aún no se ha determinado la prevalencia de motivos legítimos. Durante la limitación, los datos solo podrán tratarse con su consentimiento o para fines específicos permitidos. Será informado antes de que se levante la limitación.

4. Derecho de supresión

a) Obligación de supresión

Puede solicitar la supresión inmediata de sus datos si concurre alguna de las siguientes razones: (1) Ya no son necesarios para los fines recogidos; (2) Revoca su consentimiento y no existe otra base legal; (3) Se opone al tratamiento y no prevalecen motivos legítimos; (4) El tratamiento es ilícito; (5) Debe cumplirse una obligación legal; (6) Datos recogidos en servicios de la sociedad de la información (art. 8.1 RGPD).

b) Información a terceros

Si BMW ha hecho públicos sus datos, tomará medidas razonables para informar a los responsables que traten dichos datos de su solicitud de supresión de enlaces, copias o replicaciones.

c) Excepciones

No se aplicará la supresión cuando el tratamiento sea necesario para: (1) libertad de expresión e información; (2) obligaciones legales; (3) salud pública; (4) fines científicos, históricos o estadísticos; (5) ejercicio o defensa de reclamaciones legales.

5. Derecho a ser informado

BMW debe informar a los destinatarios de cualquier rectificación, supresión o limitación, salvo esfuerzo desproporcionado. Puede solicitar información sobre dichos destinatarios.

6. Derecho a la portabilidad

Puede recibir sus datos en un formato estructurado, de uso común y lectura mecánica, y transmitirlos a otro responsable si el tratamiento se basa en consentimiento o contrato y se realiza por medios automatizados. También puede pedir la transmisión directa entre responsables cuando sea técnicamente posible.

7. Derecho de oposición

Puede oponerse en cualquier momento por motivos relacionados con su situación particular cuando el tratamiento se base en el art. 6 apdo. 1 letra e) o f). BMW dejará de tratarlos salvo motivos legítimos imperiosos o defensa de reclamaciones.

8. Derecho a retirar el consentimiento

Puede retirar su consentimiento en cualquier momento sin afectar a la licitud del tratamiento previo.

9. Derecho a presentar una reclamación

Tiene derecho a presentar una reclamación ante una autoridad de control en su lugar de residencia, trabajo o del supuesto incumplimiento si considera que el tratamiento infringe el RGPD.

This Privacy Policy describes how BMW Group entities in the United States, including BMW NA, BMW FS, and BMW MC, and related affiliates and service providers (collectively, “BMW,” “we,” “our,” and “us”) collect, use, disclose, retain, and protect personal information relating to employees, and contractors who access or use the ONE WORKSPACE Mobile / ONE@BMWGROUP application and related services (the “App”).

1. We may collect your information when you use the App.

We may collect information about you (“personal information”) from the following sources, among others:

• From third parties, including those to whom you have previously provided information; and
• From our service providers.

App Registration. In order to provide you further services of the App, data is transferred to us when you create an account or use your pre-existing BMW account, including a username and password that are entered for authentication and authorization purposes. We process this data to provide you with the App and purposes disclosed in this Privacy Policy.

The personal information we collect from users and visitors of the App may change depending on your use of the App, however, those categories may include:

• Identifiers. Examples include name, corporate email address, employee/personnel number such as Q Number, user IDs, or other similar identifiers.
• Authentication and security data. Examples include login credentials, session identifiers, and access logs.
• Internet or other electronic network activity information. Examples include device and technical information required for App security, administration, and troubleshooting.
• Professional or employment-related information. Examples include job application or resume information, education information, title, department, organization, certifications, reviews, disciplinary actions, and similar information.
• Education information. Examples include job application or resume information, schools attended, certifications obtained, and similar information.
• Inferences. Examples may include inferences relating to your preferences, characteristics, behavior, attitudes, abilities, and aptitudes.
• Sensitive information. Examples may include state identification numbers; demographic information; citizenship or immigration status; or health-related data only when required to carry out BMW’s necessary employment and human resources functions.

We may also collect information about you from third parties. This may include third parties that you interact with or made available through the App.

We may also collect information automatically using cookies and similar online technologies or when you use the App. Such information may include internet protocol address; device identifier; browser type and language; operating system; date and time stamp; session ID; internet service provider; location information; click or touch stream data, movement, scroll, and in some cases, keystroke activity; and similar information.

2. We may use your information to provide you with the App, including for employment and related business purposes.

We may use your personal information in a variety of ways, including to:

• Provide you the App and related services;
• Manage your App account;
• Communicate with you and others;
• Provide you with customized content;
• Notify you about changes to the App;
• Address problems and review the usage and operations of the App and related services or business;
• Authenticate and authorize user access;
• Operate, maintain, and support the App;
• Protect BMW systems, employees, and information assets;
• Meet legal, regulatory, and internal governance obligations;
• For employment, human resources, benefits and salary administration, and related purposes;
• For our business purposes, including processing your requests, inquiries, or other communications with us;
• For the purposes of recruitment, employment consideration, or directory management; and
• As otherwise described to you at the point of collection.

If you provided your information for a job application, we may use that information for human resources, job placement, recruitment, qualification, or other related purposes.

We use automatically-collected information to conduct analyses about our App; associate the different devices you use; remember your browser or device; remember your preferences and interactions; deliver relevant content; and market the App to you.

We may use cookies and similar online technologies for providing the App, security, authentication, analytics, product or service improvement,  fraud detection, and for other similar purposes.

3. We may disclose your information.

In addition to disclosing your personal information as described at the time of collection, we may disclose your information with the following persons or entities or in the following circumstances, among others:

• BMW affiliates and group entities for internal administrative and operational purposes;
• Authorized service providers and contractors acting on BMW’s behalf under contractual confidentiality and data protection obligations;
• Government authorities or regulators where required by law;
• When we have your consent or at your direction;
• To perform or provide you the requested services;
• With a third party in the event that a division or product line of BMW is bought, sold, or otherwise transferred, or the third party is in the process of a potential transaction as among the transferred business assets;
• With your consent, with our business partners that administer specific programs or provide specific offerings to you;
• For employment, human resources, benefits and salary administration, and related purposes;
• For our business purposes, including processing your requests, inquiries, or other communications with us;
• Relocation, travel, transportation, or immigration purposes;
• For purposes of employment or directory management;
• When we believe such disclosure is necessary, such as to protect the rights or safety of BMW, visitors to the App, our employees, customers, or others or to address national security situations; or
• In the case of a corporate transaction, such as a merger, acquisition, or divestiture.

For personal information collected through the App, BMW does not (i) sell personal information or (ii) share personal information for cross context behavioral advertising.

We may also maintain aggregate data or other deidentified information about you, such as usage statistics, online traffic patterns and user feedback. This aggregated or deidentified information is not personal information. In addition to using this information for the purposes discussed in this Privacy Policy, we may disclose this aggregated or other deidentified information to third parties without restriction.

4. We use cookies for a variety of purposes.

We use cookies and related technologies for the following purposes, among others:

• After you have entered personal information into a form or data field on the App, cookies enable the App to “remember” that information, should you so choose;
• To deliver content that is tailored to your interests and preferences based on your past activity on the App; and
• To compile aggregate statistics concerning use of the App, analyze trends, and otherwise administer and improve the App.

We may use third-party vendors to provide you with chat features to better assist you. For recordkeeping, training, and quality assurance purposes, we or our third-party vendor may record and maintain a transcript of any communications in the chat.

5. We may use analytics services provided by others.

Our services may use third-party service providers for audience measurement and analytics purposes. These analytics services may use cookies or similar technologies to collect information to help us analyze users and how they use our services. The information collected by these technologies is used to assess how often you visit the App, what pages you view when you visit the App and similar analytics.

6. Additional Information for California Residents.

This subsection provides residents of California with additional information regarding our collection, use, and disclosure of personal information through the App. This section supplements the information contained in this Privacy Policy and applies solely to App visitors, users, and other individuals who reside in California. This section does not address or apply to our handling of publicly available information or other personal information that is exempt from California law.

A. Do Not Track Signals. The App does not recognize Do Not Track signals.

B. Categories of Personal Information Collected. BMW may collect the following categories of personal information from visitors and users of the App (followed by examples for each category) or allow you to access information in BMW’s systems relating to these categories of personal information. Additionally, the “Disclosed” column below details what categories of personal information have been disclosed in the past 12 months and to which category of third parties.

C. Sources of Personal Information; Purposes of Collection, Use, and Disclosure. The sources from which we collect personal information is summarized in the “We May Collect Your Information When You Use the App” section of this Privacy Policy.

The business or commercial purposes for which we use and disclose your personal information is described in the “We May Use Your Information to Provide You with the App, Including for Employment and Related Business Purposes” and “We May Disclose Your Information” sections of this Privacy Policy.

We may disclose your personal information to our affiliates and subsidiaries, to third parties who provide us with services to fulfill the purposes described in this Privacy Policy, in the event BMW is involved in a merger, acquisition, or sale or transfer of all or part of its assets, as otherwise required by law, and for other purposes.

D. Sale/Sharing of Personal Information. We do not sell your personal information. We do not share your personal information for behavioral advertising. Additionally, no categories of personal information outlined in this section have been sold or shared in the past 12 months.

E. Duration. The length of time BMW intends to retain each category of Personal Information, including sensitive personal information, if any, is for as long as reasonably necessary to carry out BMW’s intended business purpose for such information and in accordance with the “We May Retain Your Information in Accordance with Our Legal Obligations” section of this Privacy Policy.

7. You may have rights under applicable state laws.

You may have the following rights with respect to your personal information:

• The right to notice about our collection, use, disclosure, sale, or sharing of information about you. This Privacy Policy is intended to satisfy this right.
• The right to request access to the personal information, including the specific pieces of information that we have about you. If you are currently a BMW employee, you may access your personal information using our human resources systems (ELIDA).
• The right to request that we correct your personal information. You may correct your personal information using the information below.
• The right to request that we delete the personal information we have about you. You may request that your personal information be deleted using the information below. Please note that specific laws may require that we retain personal information in particular circumstances.
• The right to opt out of the sale or sharing of your personal information. There is no need for you to opt out of the sale or sharing of your personal information to third parties because we do not sell your personal information nor share your personal information for advertising.
• The right to ask us to limit our use of your sensitive personal information. There is no need for you to ask us to limit the use of your sensitive personal information because we do not use your sensitive personal information beyond what \ is required to conduct business, provide services to you, and as otherwise required or permitted by law.
• The right to obtain a copy of your personal information in an easily understandable and portable format that you may also request be transmitted to another entity. If you are a current BMW employee, you may access your personal information using our human resources systems.
• The right to opt out with respect to our use of automated decision-making technology, including profiling. There is no need for you to ask us to opt out of automated decision-making technology, including profiling, because we do not use automated decision-making, including profiling, (as those terms are defined under applicable law) with respect to your personal information.
• The right to be free from retaliation for exercising your rights listed above.

4. Utilizamos cookies para diversos fines.

Utilizamos cookies y tecnologías relacionadas para los siguientes fines, entre otros:

• Una vez que haya introducido información personal en un formulario o campo de datos de la aplicación, las cookies permiten que la aplicación «recuerde» esa información, si así lo desea;
• Para ofrecer contenido adaptado a sus intereses y preferencias en función de su actividad anterior en la aplicación;
• Para recopilar estadísticas agregadas sobre el uso de la aplicación, analizar tendencias y, en general, administrar y mejorar la aplicación.

Podemos recurrir a proveedores externos para ofrecerle funciones de chat con el fin de prestarle una mejor asistencia. Con fines de mantenimiento de registros, formación y control de calidad, nosotros o nuestro proveedor externo podemos grabar y conservar una transcripción de cualquier comunicación en el chat.
